When Your Child's IEP Dispute Becomes Serious, Experience Matters.
When a Florida school district refuses to provide appropriate services, fails to implement an IEP, denies an evaluation, proposes an inappropriate placement, or otherwise fails to meet your child's special education needs, parents have options.
You do not have to navigate the special education dispute process alone.
MyChildWins.com Education Advocates helps Florida parents understand their options, prepare for important meetings, challenge inappropriate decisions, and pursue remedies available under the Individuals with Disabilities Education Act (IDEA).

What Is an IDEA Due Process Hearing?
An IDEA due process hearing is a formal procedure available for resolving certain disputes between parents and public school districts involving special education.
Due process disputes may concern issues involving a child's:
Identification • Evaluation • Eligibility • Educational Placement • IEP • Special Education Services • Free Appropriate Public Education (FAPE)
A due process case is considerably different from an ordinary IEP meeting.
There may be formal pleadings, deadlines, resolution meetings, motions, evidence, witnesses, exhibits, settlement negotiations, and ultimately a hearing before an administrative law judge.
That is why preparation matters.

What Is a Resolution Meeting?
After an IDEA due process complaint is filed, a resolution meeting may be required unless the parties agree to waive it or use another permitted dispute-resolution process. The resolution meeting can be an important opportunity to resolve the dispute before a full hearing becomes necessary. Parents should understand what they are requesting, what evidence supports their position, and what terms would actually resolve the dispute.
Our extensive due process experience includes participation in resolution meetings and negotiations designed to resolve special education disputes without unnecessarily proceeding through a complete hearing.
Florida ESE & IDEA State Complaints
Due process is not the only dispute-resolution mechanism available to parents. Depending upon the problem, a parent may also consider a state complaint concerning alleged violations of special education requirements.
The appropriate remedy depends upon the facts, the alleged violation, the relief being sought, applicable deadlines, and other circumstances. We help parents understand the available options and determine an appropriate course of action for their child's situation.
What If the School Violated My Child's IEP?
An IEP is not merely a collection of suggestions. Schools have obligations concerning the special education and related services contained in a student's IEP. When required services have not been provided, an important question becomes:
What will the school do to correct what your child lost?
Depending upon the circumstances, disputes may involve compensatory education or compensatory services intended to address educational services or benefits the student should have received.
If you believe your child's IEP has not been properly implemented, talk with us about what happened.
Looking for Representation for Due Process?
Parents facing a serious special education dispute frequently begin by searching for someone qualified to represent them in an IDEA due process hearing. MyChildWins.com Education Advocates is an education advocacy organization, not a law firm. However, we can represent you in a due process hearing as your qualified representative. We believe parents should clearly understand who is providing their services and the nature of that person's role. Our team has extensive experience advocating for families in special education disputes and due process proceedings. When a matter requires services outside our role, we believe parents should understand that distinction.
