June 9, 2020 - All over the country we have been receiving reports of school districts failing to comply with the Individuals with Disabilities Education Act (IDEA). We have heard that school districts are failing to implement individual education plans. Often times, school districts have given parents the impression that school districts have the right to not follow IDEA during COVID-19. This is simply not true. Today, in her Order of Sufficiency, , Florida Administrative Law Judge Diane Cleavinger specifically noted that "there has been no waiver of IDEA and its requirements during the COVID-19 pandemic and no executive order suspending requirements."
